By using sweetelevationbakery.com, our Shopify store at sweetelevation.myshopify.com, or placing an order with us, you agree to these terms.
1. Who we are
Sweet Elevation Bakery is a sole proprietorship operated by Jennifer Gates as a registered DBA in New York State, located at 356 Troy Schenectady Rd, Latham, NY 12110. References to "we," "us," or "our" mean Jennifer Gates DBA Sweet Elevation Bakery.
2. Using our site
You may use our site to browse products, submit custom quotes, place orders, apply for jobs, and contact us. You may not use our site to harm us, our customers, or our systems, or to commit fraud.
3. Orders and payment
When you place an order, you are making an offer to buy the product. We accept your offer when we confirm the order and charge your payment method. Until then, we can refuse or cancel any order, including for suspected fraud, unexpected stockouts, or pricing errors.
All prices are in USD. Prices may change without notice but do not affect orders already placed and confirmed.
Payments are processed by Shopify and our payment processors. We do not store your full payment card information ourselves.
4. Subscriptions (Bake Club Box)
The Bake Club Box is a recurring subscription billed monthly through Shopify Subscriptions.
- Billing: monthly, on the same date each month as your initial subscription
- Cancellation: cancel anytime before the next month's box is packed and labeled, in your Shopify customer portal or by emailing sweetelevationbakery@gmail.com
- Once a box is packed and labeled, that specific order cannot be canceled, but the subscription itself can still be stopped for future months
- Pausing: email us to pause; we'll skip the next billing cycle and resume on your request
- Failed payments: we will attempt to charge again. Repeated failures will pause your subscription until you update your payment method
- Price changes: we will notify you by email at least 30 days before any subscription price change
5. Shipping
We ship within the continental United States only.
- Shipping rates are calculated at checkout based on package weight, dimensions, and destination
- Most orders ship at carrier-calculated rates via USPS or UPS
- Most boxes arrive within 3 to 5 business days
- Bake Club subscribers may see longer ship times during launch (up to 2 to 3 weeks) as we ramp up our process
- You are responsible for providing an accurate shipping address. Re-shipping to a corrected address may incur additional charges
- Once a package is marked as delivered by the carrier, we are not responsible for theft from the delivery location
6. Perishable goods
Our products are perishable, handmade baked goods that ship uninsulated. By ordering, you agree:
- Refrigerate your box immediately upon arrival
- Treats stay fresh 2 to 3 days refrigerated, or longer if frozen
- Hot weather, shipping delays, or extended porch sitting can affect quality. We cannot guarantee against this
- We may delay shipping during extreme heat to certain regions when we believe products will arrive damaged
7. Returns, refunds, and damaged shipments
See our separate Returns and Refunds Policy for full details. All sales are final on perishable products. Damaged shipments must be reported within 24 hours of delivery with photos.
8. Allergens and food safety
All of our products are made and packaged in a facility that processes wheat, gluten, and tree nuts. We cannot guarantee any product is free of cross-contamination, even items not containing those ingredients directly. If you have a severe food allergy, do not order from us.
9. Custom orders
Custom orders (cakes, cookies, cake pops, platters, etc.) are handled separately through MyCustomBakes.com. Custom orders have their own deposit, deadline, and cancellation policies, communicated at quote time.
10. Intellectual property
All content on this site, including text, photos, recipes, designs, the Sweet Elevation Bakery name, and logo, is owned by Jennifer Gates DBA Sweet Elevation Bakery or used with permission. You may not reproduce or use our content for commercial purposes without written permission. Personal use, like tagging us in a photo on social media, is encouraged.
11. Limitation of liability
Sweet Elevation Bakery's liability for any claim related to a product or order is limited to the amount you paid for that product. We are not liable for indirect, incidental, or consequential damages. This does not affect any rights you have under applicable consumer protection laws.
12. Indemnification
If your misuse of our site or violation of these terms causes us legal trouble, you agree to cover our reasonable costs.
13. Governing law
These terms are governed by the laws of the State of New York. Any disputes will be handled in courts located in Albany County, New York.
14. Changes to these terms
We may update these terms over time. The "Last updated" date at the top reflects the current version. Continued use of our site after changes means you accept the updated terms.
